What Are Statutory Positions?

According to WHS regulations, mine operators must ensure that appropriately qualified individuals are appointed to the statutory positions listed in Schedule 26 of the Work Health and Safety (Mines) Regulations 2022

Does Schedule 26 Replace Section 44?

Yes, the requirements previously outlined in Section 44 under the Mines Safety and Inspection Act 1994 have now been superseded by the Work Health and Safety (Mines) Regulations 2022.

What’s the Deadline?

According to the transitional provisions under the WHS Mines Regulations, a competent person can be appointed to a statutory supervisor position until March 20th, 2026, at the latest. Make sure you’re prepared and compliant before this deadline
